TERMS AND CONDITIONS OF USE
Welcome to AYUXA. This document is an electronic record in terms of the Information Technology Act, 2000, and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
These Terms and Conditions ("Terms") govern your access to and use of the website www.ayuxacare.com and the AYUXA mobile application (collectively, the "Platform"), operated by AYUXA HEALTH TECH PLATFORMS PVT. LTD. ("Company", "we", "us", or "our").
By accessing, registering, or using the Platform, you ("User", "you", or "your") agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
1. General Provisions & Eligibility
1.1 Eligibility: You must be at least 18 years of age to register, use the Services, or visit the Platform. By using the Platform, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.
1.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to protect your account.
2. Scope of Services
AYUXA acts as a technology platform and health care aggregator providing elder care concierge services, and facilitating the following:
- Diagnostic Services: Booking of blood tests and health checkups.
- Medicine Delivery: Facilitating the purchase and delivery of medicines and healthcare products.
- Elder Care: Providing access to caregiving and localized health support.
3. Third-Party Integrations & Partnerships
The Platform relies on several third-party service providers to deliver a seamless experience. You acknowledge and agree to the following operational parameters:
3.1 Diagnostic Partner (Redcliffe Labs): All blood tests and diagnostic services are fulfilled by our authorized partner, Redcliffe Labs. AYUXA acts solely as an aggregator and booking facilitator. The responsibility for sample collection, clinical testing, and report generation rests entirely with Redcliffe Labs.
3.2 Pharmacy & Local Stores: Medicine delivery is fulfilled by a network of independent local pharmacies and stores. AYUXA does not manufacture, stock, or dispense medicines. The local stores are solely responsible for ensuring the quality, expiry dates, and correct dispensing of medications.
3.3 Payments (Razorpay): All online financial transactions are securely processed through the Razorpay payment gateway. You are subject to Razorpay’s terms of service during the checkout process.
3.4 Communications (fast2sms): Transactional alerts, OTPs, and notifications are sent via SMS and WhatsApp APIs provided by fast2sms. By registering, you consent to receive these communications.
3.5 Location Services (Google): Mapping and routing functionalities are powered by the Google Maps API.
4. Prescription Policy for Medicines
4.1 When ordering medicines that fall under restricted schedules (e.g., Schedule H, H1), you must upload a valid, legible prescription issued by a registered medical practitioner.
4.2 The fulfilling local store reserves the right to reject an order if the prescription is found to be invalid, expired, or tampered with.
5. Payments, Fees, and Taxes
5.1 The prices for diagnostic tests, elder care services, and medicines are displayed on the Platform. We reserve the right to modify these prices at any time.
5.2 All payments must be made in Indian Rupees (INR).
5.3 Statutory taxes, including Goods and Services Tax (GST) under our registration (GSTIN: 29AAKFO1251B1ZJ), will be applicable as per law and displayed at checkout.

6. User Conduct and Restrictions
You agree NOT to:
- Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law.
- Upload any false, misleading, or deceptive information, including fake prescriptions.
- Attempt to interfere with or compromise the system integrity or security of the Platform (including the backend at ayuxa.net).
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform without express written permission from us.
7. Intellectual Property Rights
All content on the Platform, including but not limited to the AYUXA logo, text, graphics, user interfaces, visual interfaces, photographs, and the underlying source code (including the app architecture), is owned by AYUXA HEALTH TECH PLATFORMS PVT. LTD. and is protected by copyright, patent, and trademark laws.
8. Limitation of Liability and Indemnification
8.1 Limitation of Liability: In no event shall the Company, its partners (including Dhemaan Aditya and Soma Aich), employees, or agents be liable to you for any indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage resulting from your access to and use of our Platform, or (iii) any unauthorized access to or use of our secure servers.
8.2 Indemnification: You agree to defend, indemnify, and hold harmless AYUXA HEALTH TECH PLATFORMS PVT. LTD. from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms.
9. Modification of Terms
We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms at any time. It is your responsibility to check these Terms periodically for changes. Your continued use of the Platform following the posting of changes will mean that you accept and agree to the revisions.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka.
